End-User License Agreement

1. Acceptance of Terms

By downloading, installing, accessing, or using the Command Center application ("Application"), you ("User" or "you") agree to be bound by the terms of this End-User License Agreement ("EULA"). If you do not agree to these terms, do not install or use the Application.

This EULA is a legal agreement between you and EliteOps.io ("Company," "we," "us," or "our").

2. License Grant

Subject to the terms of this EULA, the Company grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Application solely for your personal or internal business purposes on devices you own or control.

3. Restrictions

You agree that you will not:

Copy, modify, or distribute the Application or any portion of it;
Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Application;
Rent, lease, lend, sell, sublicense, or otherwise transfer rights to the Application;
Remove or alter any proprietary notices, labels, or marks on the Application;
Use the Application for any unlawful purpose or in violation of any applicable laws or regulations;
Use the Application to transmit harmful, offensive, or disruptive content;
Attempt to gain unauthorized access to any part of the Application or its related systems.

4. Ownership

The Application is licensed, not sold. EliteOps.io retains all right, title, and interest in and to the Application, including all intellectual property rights therein. This EULA does not convey to you any rights of ownership in or related to the Application.

5. Updates and Modifications

The Company may, at its sole discretion, provide updates, upgrades, or patches to the Application. Such updates may be required for continued use and may be subject to additional terms. The Company reserves the right to modify or discontinue the Application at any time without notice.

6. Termination

This EULA is effective until terminated. Your rights under this agreement will terminate automatically, without notice, if you fail to comply with any of its terms. Upon termination, you must cease all use of the Application and delete all copies in your possession or control. Sections 4, 7, 8, and 9 will survive termination.

7. Disclaimer of Warranties

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

The Company does not warrant that the Application will be uninterrupted, error-free, or free of viruses or other harmful components.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE COMPANY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, BUSINESS, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THIS EULA OR YOUR USE OF THE APPLICATION, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

THE COMPANY'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THIS EULA WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID FOR THE APPLICATION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

9. Governing Law

This EULA shall be governed by and construed in accordance with the laws of the jurisdiction in which the Company is incorporated, without regard to its conflict of law principles. Any disputes arising under or in connection with this EULA shall be subject to the exclusive jurisdiction of the courts located in that jurisdiction.
